Terms of Service

These Terms include a binding arbitration agreement and a class action waiver in Section 18. They affect how disputes between you and Spike Labs are resolved. Please read them carefully.

1. Who we are and what these Terms cover

xdrama (the “Service”) is operated by Spike Labs, Inc. (“Spike Labs,” “we,” “us,” or “our”), a Delaware corporation with its principal place of business at 4845 Pearl East Cir Ste 118 PMB 522889, Boulder, Colorado 80301-6112, United States. These Terms of Service (“Terms”) are a binding agreement between you and Spike Labs and govern your access to and use of xdrama.com, our mobile applications, and all related content, features, and services.

By creating an account, watching content, purchasing coins or a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and age requirements

You must be at least 13 years old to create an account. If you are under 18 (or the age of majority where you live), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Some content on the Service is rated for mature audiences and is available only to users who are 18 or older and who have confirmed their age. We may require age verification before granting access to mature content, and we may refuse, restrict, or revoke access to any content at our discretion. Providing false age information is a material breach of these Terms.

The Service is not directed to children under 13, and we do not knowingly collect personal information from them. See our Privacy Policy for details.

3. Our content is made with artificial intelligence

xdrama series are produced using generative artificial intelligence tools. Characters, performances, voices, and settings depicted in our content are synthetic — they are computer-generated works of fiction. They are not recordings of real people or real events, and any resemblance to actual persons, living or dead, or to actual events, is unintended and coincidental unless expressly stated.

Names, characters, businesses, places, and incidents are products of imagination or used fictitiously. Nothing in our content is intended to depict, endorse, or attribute statements or conduct to any real individual.

4. Content ratings and mature material

We label series and episodes with content ratings ranging from G (suitable for general audiences) through R (restricted — intended for adults 18 and over), along with descriptors for themes such as violence, sexual content, language, and substance use. Ratings are assigned by us as an editorial guide; they are not certifications by any government or industry rating body, and they may not match ratings systems you are familiar with in your country.

Ratings are provided for your convenience and are not a guarantee about the suitability of any content for any particular viewer. You are responsible for deciding what you watch and, if you are a parent or guardian, for supervising what minors in your household watch. Where we make parental controls or content filters available, you are responsible for configuring and maintaining them.

Our content depicts fictional dramatic situations, which may include conflict, romance, crime, and other mature themes. It is entertainment, not advice, and should not be relied on as guidance of any kind.

5. Your account

You may browse limited portions of the Service without an account. To unlock episodes, purchase coins, subscribe, or sync your viewing across devices, you must create an account. You agree to provide accurate information, to keep it current, and to keep your credentials confidential. You are responsible for all activity that occurs under your account.

If you browse before signing up, we may associate your activity with a device identifier and later link that activity to your account. Accounts are personal to you and may not be shared, sold, or transferred. Notify us promptly at support@spikelabsinc.com if you believe your account has been compromised.

6. Coins, subscriptions, and payment

Free episodes. Each series makes a number of introductory episodes available at no charge. The number of free episodes varies by series and may change.

Coins. Coins are a limited, revocable license to access digital content on the Service. Coins are not money, currency, or property; they have no cash value, cannot be redeemed for cash, cannot be transferred between accounts, and cannot be sold or exchanged outside the Service. Coins are consumed when you unlock an episode. Bonus or promotional coins may expire on the schedule disclosed when they are granted.

Subscriptions. Subscriptions renew automatically at the price and interval disclosed at purchase until you cancel. You authorize us (or the applicable app store) to charge your payment method on each renewal. Prices may differ between our website and mobile app stores. You may cancel at any time, effective at the end of the current billing period; cancellation does not retroactively refund the current period.

Purchases through app stores. Purchases made through the Apple App Store or Google Play are processed by those stores under their terms, and cancellations and refunds for those purchases are handled by them, not by us.

Refunds. Except where required by law or expressly stated by us, all purchases are final and non-refundable, including unused coins and partial subscription periods. Consumers in certain jurisdictions have statutory cancellation or withdrawal rights, which these Terms do not limit.

Taxes and changes. Prices exclude applicable taxes unless stated. We may change prices, coin values, and package contents prospectively; changes will not affect coins you have already purchased or the current term of an existing subscription.

7. License to you

Subject to these Terms and your payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to stream content on the Service for your own private, non-commercial entertainment. All rights not expressly granted are reserved.

You are buying access, not ownership. Access may end if your account is terminated, if a title is removed from the Service, or if the Service is discontinued.

8. Our intellectual property

The Service and all content made available through it — including series, episodes, video, audio, scripts, characters, artwork, cover art, trailers, thumbnails, music, voices, text, software, and the xdrama and Spike Labs names and logos — are owned by Spike Labs, Inc. or its licensors and are protected by copyright, trademark, and other laws. Spike Labs retains all right, title, and interest in and to its content, including all derivative works and all output generated by or on behalf of Spike Labs using artificial intelligence.

You may not, and may not permit anyone else to:

copy, download, record, screen-capture, rip, mirror, or otherwise reproduce content, except for any offline viewing feature we expressly provide;
redistribute, publicly perform, publicly display, broadcast, or make content available to others, including on social media, streaming sites, or file-sharing services;
create derivative works from our content, including edits, dubs, translations, fan cuts, compilations, or training data for machine learning models;
circumvent, disable, or interfere with any digital rights management, paywall, geographic restriction, watermark, or other protective measure;
scrape, crawl, index, or use automated means to access the Service, or access it through any interface other than the ones we provide.

We may make promotional clips available for sharing on specific platforms. Any such sharing is permitted only through the features and channels we designate, and only in unmodified form.

9. Your content and feedback

If we enable reviews, comments, ratings, votes, or other user submissions, you retain ownership of what you submit and grant Spike Labs a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, publish, and display that submission in connection with operating and promoting the Service. You represent that you have the rights necessary to grant this license and that your submission does not violate these Terms or anyone’s rights.

If you send us ideas, suggestions, or feedback, we may use them without restriction, attribution, or compensation.

10. Acceptable use

You agree not to:

use the Service for any unlawful purpose or in violation of these Terms;
submit content that is illegal, harassing, hateful, defamatory, sexually explicit involving minors, or that infringes anyone’s rights;
impersonate any person or entity, or misrepresent your age or your affiliation with anyone;
probe, scan, overload, or attempt to gain unauthorized access to the Service or its related systems;
use the Service to develop a competing product, or to train, fine-tune, or evaluate any machine learning model;
exploit bugs, automate coin accumulation, or otherwise obtain content or credits you have not paid for.

11. Availability and changes to the Service

We are continuously developing xdrama. We may add, change, suspend, or remove series, episodes, features, and pricing at any time, and content availability may vary by region and change over time. We do not guarantee that any particular title will remain available, and removal of a title does not entitle you to a refund except as required by law.

12. Third-party services

The Service relies on third parties for authentication, payment processing, hosting, analytics, and delivery, and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is governed by their own terms.

13. Copyright complaints

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent at legal@spikelabsinc.com / 4845 Pearl East Cir Ste 118 PMB 522889, Boulder, Colorado 80301-6112, United States, including the elements required by 17 U.S.C. § 512(c)(3). We may remove material and terminate repeat infringers.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or other users. On termination, your license ends immediately and any unused coins are forfeited, except where prohibited by law. Sections that by their nature should survive termination will survive.

15. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT CONTENT RATINGS OR DESCRIPTORS WILL BE ACCURATE OR COMPLETE, OR THAT ANY CONTENT WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIKE LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CONTENT ACCESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

17. Indemnification

You agree to indemnify and hold harmless Spike Labs from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your submissions, or your violation of these Terms or applicable law.

18. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its consumer rules, in Boulder County, Colorado or by videoconference, rather than in court, except that either party may bring an individual claim in small claims court.

You and Spike Labs waive the right to a jury trial and to participate in a class, collective, or representative action. If the class action waiver is found unenforceable, the entire arbitration agreement is void. Where local law prohibits mandatory arbitration, this section does not apply to you.

19. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email before they take effect. Your continued use after the effective date means you accept the updated Terms.

20. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Spike Labs regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
